1. Agreement to Terms
By accessing or using DrumV ("the app", "service", "we", "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the app.
2. Description of Service
DrumV provides drum practice tools, including: pre-made and user-created drum patterns; a metronome and practice coach (e.g. BPM ramps); pattern editor and library; optional account features such as saving patterns, practice history, and sharing. We may add, change, or discontinue features with reasonable notice where appropriate.
3. Account and Eligibility
You must be at least 13 years old (or the age of consent in your jurisdiction) to use the app. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and notify us of any unauthorized use.
4. Acceptable Use
You agree to use the app only for lawful purposes and in accordance with these terms. You must not: (a) violate any applicable law or third-party rights; (b) upload malicious code, spam, or content that is offensive, infringing, or harmful; (c) attempt to gain unauthorized access to our systems or other users' accounts; (d) abuse or overload our systems (e.g. automated scraping, denial-of-service); (e) resell or commercially exploit the service without our permission. We may suspend or terminate accounts that violate these terms.
5. Your Content and Licences
You retain ownership of content you create (e.g. patterns). By uploading or saving content, you grant us a non-exclusive, royalty-free licence to store, process, display, and transmit it as needed to operate the app (e.g. syncing, sharing when you choose). You are responsible for ensuring you have the right to post such content and that it does not infringe others' rights.
6. Intellectual Property
The app (including design, code, branding, and our pre-made exercises) is owned by us or our licensors. You may not copy, modify, distribute, or create derivative works of our service or content except as expressly permitted (e.g. normal use of the app).
7. Audio and volume
The app uses browser-based, generated audio (Web Audio API) for practice tools only—such as metronome clicks and drum sounds—and does not use licensed music or third-party recordings. You are responsible for your device volume and listening environment. We are not liable for any hearing or other harm from misuse (e.g. prolonged high volume or use in unsafe environments). We recommend using the app at a reasonable volume and in a safe environment.
8. Disclaimers
The app is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted, error-free, or fit for any particular purpose. We are not liable for any decisions you make based on the app (e.g. practice routines). Use of the app is at your own risk.
9. Limitation of Liability
To the maximum extent permitted by law, we and our affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from your use of the app. Our total liability for any claims related to the service shall not exceed the amount you paid us in the twelve months before the claim (or, if nothing was paid, zero).
10. Indemnification
You agree to indemnify and hold harmless us and our affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the app, your content, or your breach of these terms.
11. Termination
You may stop using the app and delete your account at any time via Settings. We may suspend or terminate your access if you breach these terms or for other operational or legal reasons. Upon termination, your right to use the app ceases; we may retain or delete your data as described in our Privacy Policy.
12. Changes
We may update these Terms from time to time. We will notify you of material changes (e.g. in-app or by email). Continued use after changes constitutes acceptance. If you do not agree, you must stop using the app and may delete your account.
13. General
These terms constitute the entire agreement between you and us regarding the app. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a right does not waive it. These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-law principles.
